These Terms and Conditions apply to all transactions conducted through our online shop.
1. Our Contract
1.1 These Terms and Conditions govern the supply of goods sold by Cool Auto, 34 Moor Close, North Shields, Tyne & Wear, NE29 8db ("we" and "us") to the customer ("you") and constitute the entire and only agreement between us in relation thereto.
2. Pricing & Availability
2.1 All product prices are in £ sterling do NOT include delivery unless otherwise stated.
2.2 We reserve the right to change any advertised price before accepting an order.
2.3 Prices with a marked United Kingdom recommended retail price (UK RRP) refer to prices the manufacturer recommends goods are sold at in the UK market, or prices that retailers within the UK market are currently offering the same product.
2.4 Sale prices are valid at the time of sale only and may be withdrawn at anytime.
2.5 All products are subject to availability and may be withdrawn at any time.
2.6 If your order cannot be fulfilled you will be offered an alternative or given a refund for the unavailable product(s).
2.7 Occasionally, an error may occur with our website and goods may be incorrectly priced in which circumstances we will not be obliged to supply goods at the incorrect price.
3. Product Details
3.1 Some products may have an associated image(s) or photo(s).
3.2 We try to ensure the accuracy of these images or photos, but they are for reference only and should be considered illustrative.
3.3 In the case of unboxed items the price of the equivalent regular goods may be shown for reference only.
3.4 By submitting your order to us you are confirming that you are aware of this fact and do not consider this to be a problem with ordering that product.
4. Order Payment
4.1 Card payments through our online shop are processed by Protx to ensure complete security and privacy.
4.2 Payments can be made using the options available through Protx including Credit and Debit cards from Visa, Mastercard, Electron.
4.3 Payments are subject the Protx terms and conditions.
4.4 We also accept payment by credit/debit card by phone or by cheque, but we will not dispatch goods until the funds have cleared and we have received full payment.
5. Order Confirmation
5.1 You may be sent an e-mail confirming receipt of your order with our store.
5.2 We reserve the right to decline any order.
5.3 All orders are placed subject to acceptance by us by delivery of the goods to you at which point a legally biding contract is constituted between us.
5.4 The processing of your payment and acknowledgement of your order does not constitute legal acceptance of your order.
6. Delivery
6.1 The delivery charge shown on the website is for UK mainland only.
6.2 Please e-mail us for details of delivery charges outside UK mainland.
6.3 We aim to process orders the same day and dispatch for delivery the following day, but this is not always possible.
6.4 Due to the nature of ordering on the Internet it is not possible for you to specify a delivery date.
7. Security
7.1 Personal and credit card details are sent to Protx using secure Internet Technology.
7.2 We cannot be held liable for any loss you may suffer if a third party procures unauthorised access to any data you provide when accessing or ordering from our website.
8. Liability
8.1 We will not be liable to you for any loss of profits, administrative inconvenience, disappointment, indirect or consequential loss or damage arising out of any problem in relation to the goods and we shall have no liability to pay any money to you by way of compensation other than any refund we make under these conditions.
9. Complaints
9.1 If you are not satisfied with any product please let us know by e-mailing: customerservice@coolauto-onlineshop.co.uk.
9.2 We will acknowledge complaints within 5 working days of receipt.
9.3 We will endeavour to resolve any complaint within 30 days.
10. Statutory Rights
10.1 These Terms and Conditions do not affect your statutory rights as a consumer.
11. Force Majeure
11.1 We shall have no liability to you for any failure or delay in supply or delivery or for any damage or defect to goods supplied or delivered hereunder that is caused by any event or circumstance beyond our reasonable control (including, without limitation, strikes, lockouts and other industrial disputes).
12. Jurisdiction
12.1 Sales on this web site are governed by English law and you agree to submit any dispute to the exclusive jurisdiction of the English courts.
12.2 All orders are subject to these terms and conditions, and no amendments will be accepted by us.
